Beta Tester Agreement & Liability Waiver

1. Purpose & Program Scope

This Beta Tester Agreement and Comprehensive Liability Waiver (“Agreement”) is entered into between Perrymore Calendar (“Perrymore”, “we”, “us”, or “our”) and the individual household administrator, family member, or tester (“Beta Tester”, “you”, or “your”) accessing developmental, pre-release, or pilot versions of the Perrymore platform.

The sole purpose of this closed beta program is to evaluate system performance, uncover software defects, stress-test synchronisation algorithms, and gather domestic user feedback across real-world family workflows prior to broad public commercial release.

2. License Grant & Complimentary Family Pro Consideration

Subject to your continuous compliance with this Agreement and the standard Perrymore Terms of Service, Perrymore grants you a non-exclusive, non-transferable, revocable, single-household license to access and test the platform.

Nominal Consideration: In exchange for your active participation and periodic feedback, Perrymore provides your registered household with 100% complimentary access to the full Family Pro tier (standard retail value £8.99/month or £79.99/year) without payment card collection, trial countdown timers, or automatic billing.

3. Experimental Nature & Absolute Exclusion of Warranties

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

• The Service is experimental, developmental, and uncertified for critical domestic reliance.
• The software may contain programming bugs, design flaws, visual glitches, unexpected data synchronisation anomalies with external services (such as Google Calendar or Gmail), and unplanned server downtime.
• Google OAuth Beta Whitelisting: Connecting a Google account requires prior registration of your submitted email in the developer’s Google Cloud Console tester directory. While you can selectively choose which family calendars sync into your hub, all incoming emails for your chosen account will be accessible in your family Email Triage.
• Features and interfaces may be radically modified, added, or deprecated at any time without advance warning or liability.
• THE BETA SERVICE IS PROVIDED STRICTLY “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TIMELINESS, ACCURACY, OR CONTINUOUS AVAILABILITY.

5. Mandatory Duty of Secondary Record-Keeping

You explicitly agree that you will not rely solely on the beta software for mission-critical family management. You warrant that your household maintains independent secondary copies of critical bookings, train/flight itineraries, urgent medical timings, and essential school commitments throughout the duration of the pilot.

6. Feedback & Intellectual Property Assignment

We welcome constructive feedback, feature ideas, error logs, and usability suggestions via our dedicated portal (/feedback) or questionnaire checkpoints.

By submitting feedback, suggestions, or bug reports, you grant Perrymore an irrevocable, perpetual, worldwide, transferable, sublicensable, fully paid-up, royalty-free license to use, incorporate, adapt, commercialise, and publish such contributions without compensation, accounting, or attribution to you. All intellectual property rights in enhancements or modifications developed from your feedback remain exclusively with Perrymore.

7. Confidentiality & Responsible Disclosure

You agree to exercise reasonable discretion regarding pre-release features, experimental interfaces, and technical specifications disclosed during the beta period.

Responsible Disclosure & AI Testing: If you identify any software vulnerability, unintended data exposure, or security issue, you agree to immediately notify our technical team confidentially at [email protected] and refrain from disclosing or demonstrating the issue publicly until a remediation patch has been deployed. Beta testers agree to evaluate the platform in good faith and must not execute adversarial prompt injection, model jailbreaks, data poisoning, automated scraping, or security evasion against AI endpoints or infrastructure.

8. Privacy, UK GDPR & Immediate Erasure Rights

Your domestic privacy remains our foremost priority throughout the beta program:

• We process personal data strictly pursuant to our Privacy Policy and UK GDPR principles.
• We do not sell personal details, inject advertising trackers, or share family agendas with third-party brokers.
• 1-Click GDPR Hard Delete: As household administrator, you may permanently purge your household’s data, member profiles, synced integrations, and feedback history at any time by navigating to Settings → Privacy & Data Protection.

9. Term, Termination & Transition

Either party may terminate this Agreement and your participation in the beta program at any time, with or without notice or cause.

Upon conclusion of the closed beta period, your household hub will gracefully transition to the complimentary Family Essentials tier without unexpected fees. You will be given the option to continue on Family Essentials or upgrade to a commercial plan.

10. Governing Law & Jurisdiction

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
